Temperature Regulation 2025: Fines and Air Conditioning

Evita multas por calor en el trabajo. Cumple la normativa y protege tu empresa con soluciones de climatización profesional de Esencial.

With summer on the way, an old concern for anyone working in enclosed spaces or under the sun has become a serious issue: now, letting employees suffer in the heat can result in fines easily exceeding €900,000. The government has tightened controls, is notifying businesses, and inspections promise to be rigorous.

Why are we talking about this at Esencial?
Because we’re air conditioning specialists—and it’s never been more urgent to ensure fresh, safe environments at work. This blog post isn’t just a warning; it’s a practical guide: we’ll tell you what’s changed in the law and how air conditioning can mean the difference between a calm summer and a real headache with the inspectors.

What’s changed in the law?
If heat was just an annoyance before, now it’s a matter of official inspection and serious penalties. Just this month, over 112,000 companies have already received government notifications about new requirements to protect workers from extreme heat—especially in sectors like construction, agriculture, hospitality, retail, workshops, factories, and warehouses.

The rule is clear: if there’s no shade, drinking water, breaks, and above all, air-conditioned spaces (when possible), the fine can range from €1,451 up to almost one million euros. What used to be considered a “detail” is now a top priority for the Labour Inspectorate, which has already announced surprise inspections between June and September.

What does your company need to guarantee?

  • Drinking water always available
  • Shaded areas or air-conditioned spaces
  • Breaks during the hottest hours
  • Indoor spaces that are cool and well-ventilated

If these conditions aren’t met, on top of the fine, the company may also have to grant up to four days of “climate leave” to employees, with full pay. In other words, apart from health risks, there’s direct financial harm.

Why is air conditioning the best practical solution?

There are no “shortcuts” when it comes to extreme heat and legal requirements. Air conditioning has become an essential ally for any business wanting to comply with the law, look after their team, and avoid problems.

That’s where Esencial comes in: we specialize in installing and recommending portable coolers, air conditioning solutions, and practical systems for all kinds of spaces—from small offices and large restaurants to factories, workshops, and industrial buildings.

With a well-air-conditioned environment:

  • You show genuine concern for your team
  • You guarantee greater productivity and well-being
  • And, above all, you avoid the risk of fines and notifications

Why are we talking about this?

It’s simple: because some people still think air conditioning is a “luxury.” It’s not. Now, it’s a legal requirement. Our aim is to inform you, help you prevent penalties, and show that with the right solutions, you can get through the summer peacefully—no nasty surprises, no losses.
